Acceptance of Terms

By accessing and using Banana AI Pro services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service. These terms apply to all users of the service, including visitors, registered users, and subscribers.

Service Description

Banana AI Pro provides AI-powered image generation and editing services using supported models including Nano Banana, Nano Banana Pro, and other third-party AI models. Our platform allows users to:

Transform images using natural language descriptions
Generate image edits from text descriptions
Access various AI models with different quality levels
Manage content through user dashboards
Purchase credits and manage subscriptions

User Accounts and Responsibilities

Account Creation

You must provide accurate and complete information
You are responsible for maintaining account security
You must be at least 13 years old to use our service
One account per person or entity

Prohibited Activities

Sharing account credentials with others
Attempting to bypass payment systems or credit limits
Using automated systems to access the service
Engaging in fraudulent or illegal activities

Content Standards and Prohibited Categories

Strictly Prohibited Content

You must not use Banana AI Pro to generate, request, upload, edit, distribute, or facilitate prohibited content. These restrictions apply to prompts, source materials, generated images or videos, and any related use of the service.

1. Pornographic, Sexual, or NSFW Content

Sexually explicit, pornographic, exploitative, or otherwise NSFW content, including sexualized nudity or sexual content created for arousal.

2. Violence or Gore

Graphic violence, gore, torture, dismemberment, or content that glorifies, encourages, or depicts serious violence in a gratuitous manner.

3. Hate Speech or Discriminatory Content

Content that attacks, dehumanizes, threatens, or promotes discrimination or violence against individuals or groups based on protected characteristics.

4. Child Safety and CSAM

Any child sexual abuse material (CSAM), sexualized depiction of a minor, child exploitation, grooming, or content that otherwise endangers or exploits children.

5. Deepfakes or Impersonation

Non-consensual deepfakes or content intended to impersonate, misrepresent, deceive, or falsely portray another person, including through use of their likeness, voice, or identity.

6. Copyright or Trademark Infringement

Content that infringes or misappropriates another party's copyright, trademark, or other intellectual-property rights, including use of source materials, brands, or logos without the necessary rights or authorization.

Important: Content rejected by supported third-party AI models for policy violations will result in credit deduction without image generation. Users are responsible for ensuring compliance before submission.

Original creative content and artwork
Educational and informational materials
Business and promotional content (following guidelines)
Entertainment and artistic expressions
Personal photos and memories, only where you have the necessary rights and consent

Content Moderation

We use a layered approach to help enforce these standards. Moderation safeguards may not identify every violation, and users remain responsible for ensuring that their use of the service complies with these Terms.

Automated Screening

Generation prompts are screened before processing. A request that is denied or flagged by our safety checks may be blocked from generation.

Provider Safety Controls

Supported third-party AI model providers may apply additional safety controls and can reject requests or outputs that do not meet their policies.

Review of Flags and Reports

Our team reviews user reports and may review flagged content, related account activity, and available records to investigate suspected violations and apply enforcement measures.

Reporting Content and Misuse

You may report suspected violations of these standards, including child-safety concerns, impersonation, or infringement of your rights, through our contact page or by emailing support@bananaai.pro.

What to Include

Please provide the relevant page URL or generation details, a description of the concern, and any information that establishes your ownership or authority where you are reporting infringement or impersonation. Do not attach or reproduce illegal content, especially suspected CSAM, in your report.

We handle reports as confidentially as reasonably possible, review them objectively, and may take action against reports that are knowingly false or abusive.

Enforcement for Violations

We assess enforcement based on the severity of the violation, risk of harm, available evidence, and prior violations. We may act without prior notice where necessary to protect users, the public, or the service.

Reject or block a generation request
Remove or disable access to violating content
Issue a warning or restrict access to features or models
Temporarily suspend or permanently terminate an account
Preserve relevant records and report to, or cooperate with, law enforcement or other authorities when required by law or necessary to address serious harm

Payment Terms and Credits

Credit System

Credits are consumed upon generation request submission
All image generations: 1 credit per generation (regardless of model)
Credits are charged immediately when generation starts
Credits are non-refundable and non-transferable
Failed generations due to content policy still consume credits

Subscriptions

Monthly recurring billing on subscription date
Credits allocated immediately upon payment
Unused credits reset monthly
Cancel anytime before next billing cycle
No partial refunds for unused time/credits

Important Payment Policies

Failed Generations: Credits are deducted regardless of generation success or content rejection
Refund Policy: Technical failures on our end may be eligible for credit refunds at our discretion
Billing Issues: Contact support within 7 days of billing for dispute resolution
Price Changes: 30-day advance notice will be provided for subscription price changes

Intellectual Property Rights

Your Content Rights

You retain ownership of the original content you provide (images, text prompts). By using our service, you grant us a license to process your content for the purpose of providing AI image editing services.

Generated Content

You own the rights to images generated from your content, subject to the rights of any third-party materials included in your original content. Generated content is provided "as-is" without warranties regarding originality or infringement.

Our Platform Rights

The Banana AI Pro platform, including software, algorithms, user interface, and branding, is owned by us and protected by intellectual property laws.

Limitation of Liability

We are not liable for:

Content rejection by AI models or third-party services
Loss of data, credits, or generated content
Service interruptions or technical issues
Damages resulting from use of our service

Copyright or trademark infringement claims

Our total liability to you for all claims will not exceed the amount you paid us in the 12 months preceding the claim.
